Terms of Service

1. Acceptance

By accessing chilimode.com or purchasing, downloading, or using the Chili Mode application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the website or the App.

These Terms form a binding agreement between you and Pauline ("we", "us"), the sole developer of Chili Mode, based in France. For any question about these Terms, write to pau@chilimode.com.

2. The service

Chili Mode is a macOS application that replaces the standard window-close animation with a custom burn effect. The website chilimode.com promotes, sells, and supports the App.

The App is sold as a one-time purchase that grants you a license to use it. Payment, license delivery, and download distribution are handled by our partners Amore.computer and Stripe (see the Privacy Policy for details).

3. License grant

When you purchase Chili Mode, we grant you:

• A personal, non-exclusive, non-transferable, non-sublicensable license to install and use the App on your personal Mac computer(s).
• The right to receive updates and bug fixes for as long as the App is actively maintained.

You agree not to:

• Resell, redistribute, sublicense, lease, rent, or transfer the App or your license key to anyone else.
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except where this right is granted to you under applicable law.
• Use the App for any unlawful purpose or in a way that could damage other systems or users.
• Share your license key publicly or with others. Each license is for a single user.

4. Pricing and payment

The current price of Chili Mode is shown on the website at the time of purchase. Prices include any applicable VAT or sales tax, which is calculated, collected, and remitted by Stripe (Merchant of Record) on our behalf.

All payments are final once a purchase is completed, subject to the refund policy described in Section 5.

5. Refunds and the EU right of withdrawal

Chili Mode is a digital product delivered immediately upon purchase. Under EU consumer protection law (Directive 2011/83/EU), consumers normally have a 14-day right to withdraw from purchases. However, this right is waived for digital content that is delivered immediately, provided you consent to immediate delivery and acknowledge that you lose your withdrawal right — you'll be asked to confirm this at checkout.

Outside of this legal framework, we offer a discretionary refund policy:

• If the App fails to work on your hardware or operating system as described, contact us within 14 days of purchase and we will issue a full refund.
• If you encounter a critical bug we cannot resolve, contact us and we will issue a full refund.
• Refund requests for reasons other than the above are evaluated on a case-by-case basis.

Refund requests should be sent to pau@chilimode.com with your order ID.

6. Intellectual property

Chili Mode, including its source code, design, animations, branding, the chilimode.com website, all written content, visual assets, and the "Chili Mode" name and logo, is the exclusive intellectual property of its creator. All rights not expressly granted to you in these Terms are reserved.

You may not copy, reproduce, imitate, or create derivative works based on Chili Mode without explicit prior written permission.

7. System requirements

Chili Mode currently requires macOS 14.6 (Sonoma) or later and an Apple Silicon Mac (M1 Pro or newer). System requirements may change in future versions. We recommend checking the current requirements on the website before purchase. We are not responsible for incompatibility with hardware or operating systems that fall outside the stated requirements.

8. Updates and changes to the App

We may release updates, bug fixes, new features, or new versions of Chili Mode from time to time. We may also, in our reasonable discretion, modify or discontinue features. We will make reasonable efforts to communicate significant changes through the App or by email to license-holders.

9. Disclaimers

Chili Mode is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or perfectly compatible with every configuration of macOS.

Your statutory rights as a consumer under EU and French law are not affected by this disclaimer.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of revenue, or loss of profit, arising from your use of Chili Mode. Our total cumulative liability under these Terms shall not exceed the amount you paid for the App in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under French or EU law.

11. Termination

Your license to use Chili Mode is granted indefinitely unless terminated. We may terminate or suspend your license if you materially breach these Terms (for example, by sharing your license key, reverse-engineering the App, or using it unlawfully). Upon termination, you must stop using the App and delete it from your devices.

12. Governing law and jurisdiction

These Terms are governed by the laws of France. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France, except where mandatory consumer protection law gives you the right to bring proceedings in your own country of residence.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the latest revision. For material changes, we will notify license-holders by email or through the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
